05/ 15.06.2023 . Apprehending his arrest, petitioner above-named has moved this Court for grant of anticipatory bail in connection with Tethaitanagar P.S. Case No.62 of 2022 registered under Sections 414/34 of the Indian Penal Code and under Section 11(D)(F) of Cruelty to Animal Act, 1960 and Section 12(i)(ii)(iii)/ 13 of Jharkhand Bovine Animal Prohibition and Slaughter Act, 2005.

It is submitted by learned counsel for the petitioner that the offence under Section 414 IPC will not be made out as there is no theft report regarding theft of cattle which were allegedly being taken by this petitioner. It is submitted that offence under Section 11(D)(F) of Cruelty to Animal Act, 1960 and Section 12(i)(ii)(iii)/ 13 of Jharkhand Bovine Animal Prohibition and Slaughter Act, 2005 are not made out. It is submitted that these cattle were purchased bona-fide and the petitioner has receipt of the purchase of the cattle.

Learned SPP for the State has vehemently opposed the prayer. It is submitted that no document was produced when the cattle were seized, as such, ante-dated documents manufactured cannot be ruled out. It is submitted that the petitioner has also criminal antecedent.

Considering the submissions of learned counsel and the fact as discussed above, the anticipatory bail application is allowed. Hence, in the event of his arrest or surrender within a period of two weeks from the date of this order, the petitioner named above shall be released on bail on furnishing bail bond of Rs.25,000/(Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below, subject to the conditions laid down under Section 438(2) Cr. P.C.

The petitioner will co-operate in the investigation and will appear on notice under Section 41 A of Cr.P.C. as and when his presence is required.
