Petitioner is apprehending his arrest in connection with Torpa P.S. Case No. 100 of 2022, for the offences registered under Section 414 of the Indian Penal Code, Sections 4/21 of the Mines & Minerals (Development & Regulations) Act, 1957, Rule 54 of the Jharkhand Minor Minerals Concession Rules, 2004 and Sections 7/9/13 of the Jharkhand Mineral (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017, pending in the court of Sri Dinesh Bauri, learned S.D.J.M., Khunti.

It is alleged that petitioner is the owner of the truck bearing registration No.JH01DB-2608, which was seized by the District Mining Officer (Torpa), Khunti, loaded with 700 CFT. of illegal sand.

It was submitted that driver of the offending vehicle was transporting the seized sand without knowledge and consent of the petitioner. It was further submitted that petitioner has got no criminal antecedent and this fact has been mentioned at paragraph-16 of the Anticipatory Bail Application.

Learned A.P.P. has opposed the prayer for Anticipatory Bail.

Regard being had to the facts and circumstance of the case, I am inclined to enlarge the petitioner on anticipatory bail. He is directed to surrender before the court below within two weeks from the date of receipt of copy of this order, and learned court below on his surrender shall release him on bail on furnishing bail bonds of Rs. 25,000/- (Twenty five Thousand only) with two sureties of the like amount each to the satisfaction of Sri Dinesh Bauri, learned S.D.J.M., Khunti or his successor in connection with Torpa P.S. Case No. 100 of 2022. Subject to the conditions as laid down under Section 438 (2) Cr.P.C.
