Petitioners are apprehending their arrest in connection with Complaint Case No. 1161 of 2022, registered under Sections 33/ 41/ 42 of the Indian Forest Act, pending in the Court of leaned C.J.M., Chatra.

On 12.11.2022 at about 01:30 A.M, the forest ranger of Jhulandiya forest area, received confidential information that illegal coal was being excavated from the forest area. On the basis of this information the informant party went to the place of occurrence and seized a truck bearing registration number JH-02AS-2809. On the basis of confidential information, it transpired that the petitioners were involved in excavation of the illegal coal.

It was submitted that the prosecution has not disclosed the name of the persons who have implicated the petitioners. It was further submitted that the petitioners have got no criminal antecedent and this fact has been mentioned at paragraph-13 of the Anticipatory bail application.

Regard being had to the facts and circumstance of the case; I am inclined to extend the privilege of Anticipatory Bail to them. They are directed to surrender before the court below within two weeks from the date of receipt of copy of this order and learned court below on their surrender shall release them on bail on

furnishing bail bond of Rs. 25,000/- (Twenty five Thousand only) each with two sureties of the like amount each to the satisfaction of leaned C.J.M., Chatra in connection with Complaint Case No. 1161 of 2022, Subject to the conditions as laid down under Section 438 (2) Cr.P.C.
