04/18.04.2023 The applicant who is in custody since 22.10.2022 has approached this Court for grant of regular bail in connection with POCSO Case No.86/2022 arising out of Panki P.S. Case No.105/2022, registered for the offence under Sections 366A/ 120B of IPC and Sections 4 and 8 of the POCSO Act.

The applicant is an accused of committing rape on the false pretext of marriage.

It has been submitted by learned counsel for the applicant(s) that complete set of F.I.R. alongwith its enclosure have been annexed with this bail application and there is no suppression on his/her part .

Innocence has been claimed and undertaking has been given for participation in the trial. It has been submitted by learned counsel for the applicant that both were having good friendship but due to the disagreement between their parents, the marriage could not be solemnized. On above basis prayer for bail has been made.

Learned A.P.P. and learned counsel for the informant have opposed the prayer for bail of the applicant.

Having heard learned counsel for the parties and from perusal of record, it appears that the age of the girl has been shown just below the age of 18 years but as per the medical report she is aged about 20 years.

Considering the statement of the victim girl recorded under Section 164 Cr.PC., I am inclined to enlarge the applicant on bail. Accordingly, the applicant, named above, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO Act, Palamau in connection with POCSO Case No.86/2022 arising out of Panki P.S. Case No.105/2022, subject to the conditions that the applicant will submit self-attested copy of his/her/their Aadhaar Card and also give his/her/their mobile number before the learned court below which he/she/they will not change during pendency of this case without prior permission of the court.
