The petitioner is praying for grant of bail as he is in custody for allegedly committing offence punishable under Section 279, 337, 338, 272, 273 and 120B of IPC and under Section 47(A) of the Excise Act in connection with Saraiyahat P.S. Case No.58 of 2018, pending in the Court of learned J.M., 1st Class, Dumka.
It is alleged that 180 bottles of foreign liquor were recovered from pickvan, which met with an accident. Three persons are involved in this case and petitioner is one of them.
Learned counsel for the petitioner submits that two co-accused persons, namely, Suman Kumar and Babbar Kumar have already been granted bail by this Court vide order dated 02.08.2018 in B.A. No.6297 of 2018 and he is in custody since 30.08.2023.
Considering the period of custody of the petitioner and the fact that co-accused have been granted bail by this Court, I am inclined to grant bail to the petitioner. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Dumka in connection with Saraiyahat P.S. Case No.58 of 2018.
