14/08.12.2023: This application has been filed for condoning the delay of about 86 days in filing this petition.
In view of submissions made in this application, the delay of 86 days in filing the instant petition is condoned.
Accordingly, this application stands allowed .
C.M.P. No. 12 of 2020
Learned counsel for the petitioner submits that the defects, which were there in the notice filed in S.A. No. 491 of 2016 has been cured by the petitioner. He further submits that the Office may kindly be directed to issue the notices, for which the requisites have already been filed.
Considering the fact that the defects, as pointed by the Registry in S.A. No. 491 of 2016 have already been removed, I am inclined to allow this petition. Accordingly, this petition is allowed.
Consequently, S.A. No. 491 of 2016 is restored to its original file.
Office is directed to proceed for service of notice.
