When the matter is called out, the learned counsels for the parties have appeared.

This appeal has been filed against the order dated 27.4.2023 passed by the learned Court of Special Judge SC/ST (Prevention of Atrocities) Act, Palamau in ABP No. 360 of 2023, corresponding to Hussainabad PS Case No 136 of 2022.

The learned counsel for the appellants submits that allegations are under many sections of IPC as well as under SC/ST (Prevention of Atrocities) Act. He further submits that the parties have compromised the case and to that effect statement of compromise signed by both the parties which was also submitted at the time of anticipatory bail petition before the learned court below is annexed at page 16 to 18 of the appeal. He has further submitted that in view of the fact that injuries are simple in nature and the matter has been compromised with, the prayer for anticipatory bail of the appellant may be considered.

The learned counsel for the informant has not opposed the submissions made on behalf of the appellant and factum of compromise which has taken place between the parties.

The learned counsel for the State has opposed the prayer for anticipatory bail and submitted that it is indicated in the order passed by the learned court below that as per section 18 of the SC/ST Act bail petition is not maintainable

Regard being had to the aforesaid facts, I am inclined to extend

the privilege of anticipatory bail to the appellants, named above. Accordingly, the appellants are directed to surrender before the learned Court below within a period of three weeks from today and on their surrender or arrest, they shall be released on bail on furnishing bail bond of Rs. 25,000/(Rupees Twenty Five Thousand Only) each with two sureties of the like amount each to the satisfaction of Court of Special Judge SC/ST (Prevention of Atrocities) Act, Palamau in ABP No. 360 of 2023, corresponding to Hussainabad PS Case No 136 of 2022, subject to the conditions that (i) the appellants shall attend the trial regularly, (ii) the appellants shall furnish their mobile number and photocopy of the Aadhar Cards with an undertaking that they will not change their number during pendency of the case and (iii) the appellants shall report to the concerned police station on last Saturday of every month between 1:00 pm and 5:00 pm in the next twelve month, failing which their bail bonds shall be liable to be cancelled. Any exception to such attendance shall be done so after direction from the learned Court below.

This appeal stands allowed and disposed of.
