Learned counsel for the petitioners, Mr. Jay Prakash Pandey has submitted that petitioners have preferred this writ petition for direction upon the respondent to fix the rent with regard to the land of Khata No.114, Plot No.1210, Area 0.79 acres situated at Mauza Nyee Param, P.O. & P.S. Tandwa, District Chatra although the land stands recorded in R.R. Khatiyan in the name Kalu Sonar, S/o Late Tikar Sonar and the land in question is belagam.
Learned counsel for the respondents-State, Mrs. Darshana Poddar Mishra, AAG-I assisted by Mr. Awanish Shekhar has submitted that as per the pleading of the petitioners, it was belagam land, so he cannot ask to fix the rent and secondly the petitioners is not in possession of the land rather Block of the Tandwa has been constructed over the land long back and a portion of the same is under possession of the NTPC, as such, State may not be directed to fix the rent. Petitioners may avail the legal remedy available under the law.
Upon which, learned counsel for the petitioners, Mr. Jay Prakash Pandey has submitted that petitioners may be allowed to withdraw the writ petition, so as to avail the legal remedy available under the law with regard to their land.
Accordingly, the instant writ petition is dismissed as withdrawn.
