Learned counsel for the petitioners, Mr. Ankit Vishal has submitted, that the present writ petition i.e. W.P. (C) No. 7155/2012 has been filed by Adhunik Alloys & Power Limited, through its Authorised Signatory Shri Sanjay Pratap, son of Jitendra Pratap Singh on 03.12.2012.

Another Authorised Signatory, Niraj Kumar Gupta, son of Late Prof. J.K. Gupta, resident of Shanti Kutir, Shukla Colony, Hinoo, P.O. & P.S. - Hinoo, District – Ranchi has preferred the present I.A. No. 10709/2022 for withdrawal of W.P. (C) No. 7155/2012 on 22.11.2022 through the same counsel on the ground that North Dhadhu Coal Block as allocated has been ordered to be deallocated and the Bank Guarantee for Rs. 56.03 crores furnished by the Joint Venture Company formed by the allocatees has been directed to be forfeited.

Learned counsel for the petitioners has submitted, that during pendency of the instant writ petition, by letter dated 10^th August, 2021, issued by Ministry of Coal, it is communicated to the petitioners that recommendations of 44^th meeting of IMG is accepted by the competent authority and it is decided to release the Bank Guarantee in respect of North Dhadhu Coal Block amounting to Rs. 56,03,00,000/- to the prior allottee.

Learned counsel for the petitioners has further submitted, that in view of the above letter, the petitioners made an application on 20^th August, 2021, for release of Original Bank Guarantee No.

0999809BG0000189 amounting to Rs. 56,03,00,000/-. The office of the Coal Controller, Ministry of Coal, Government of India, thereafter by covering letter dated 28.09.2021 has returned the Original Bank Guarantee bearing No. 0999809BG0000189 amounting to Rs. 56,03,00,000/-.

Learned counsel for the petitioners has further submitted, that in view of the subsequent developments i.e. de-allocation of Coal Blocks by the Hon'ble Apex Court in the case of Manohar Lal Sharma v. The Principal Secretary & Ors. and return of the Original Bank Guarantee the prayer in the present writ petition has become infructuous, as such petitioner wants to withdraw the same.

Learned senior counsel for the respondents / UOI, Mr. Anil Kumar, Additional S.G.I. and learned counsel, Mr. Pratyush Kumar, C.G.C. have no objection.

Considering the same, I.A. No. 10709/2022 is allowed.

The present writ petition is dismissed as withdrawn.
