3. This writ petition has been filed for the following relief:
“For a direction commanding upon the concerned respondents to reinstate the petitioner in service by way of Fresh Appointment as per the letter dated 20.03.2012 issued by the General Manager (P & IR), Bharat Coking Coal Limited;
And
Petitioner further prays for issuance of appropriate writ or writs, order or orders, direction or directions, commanding the concerned respondents to take a final decision on the Mercy appeal dated 20.02.2019 of the petitioner which is pending before the Director (Personnel), Bharat Coking Coal Limited.”
4. Learned counsel for the petitioner submits that the petitioner was dismissed from service on account of unauthorized absence vide order dated 21.08.2006. Pursuant to Circular dated 20.03.2012, the petitioner had filed mercy appeal vide Annexure – 4 dated 06.02.2019

and as no decision was taken, the petitioner has moved the present petition.
5. Learned counsel for the respondents while opposing the prayer has submitted that the petitioner was not eligible as per the Circular dated 20.03.2012. He refers to Clause – 3 and clause 15 of the said Circular.
6. At this, learned counsel for the petitioner seeks permission to withdraw this writ petition to approach the respondents for redressal of his grievances.
7. Considering the aforesaid submissions, the present petition is disposed of as withdrawn with a aforesaid liberty to the petitioner to approach the respondents for redressal of his grievances who in turn may proceed in accordance with law.
