06/ 06.07.2022 . After some argument, Mr. Mahesh Kr. Sinha, learned counsel for the petitioner has submitted that the petitioner may be permitted to withdraw the instant Writ Petition so as to avail legal remedy available under Section 3G (5) of the National Highway Authority Act, 1956.
Mr. Sidharth Ranjan, learned AC to Sr.S.C.-II for the State and Mrs. Sweety Topn, learned counsel for the NHAI have no objection.
Considering the same, the writ Petition stands dismissed, as withdrawn.
However, if the petitioner files an application /representation before the competent authority, within a period of 30 days from today, the concerned authority shall pass a reasoned order within a period of 60 days thereafter in accordance with law.
