This criminal miscellaneous petition has been filed under section 482 Cr.P.C by the petitioner with a prayer for modification of the order dated 24.11.2021 passed in ABA No. 8670 of 2021.
It is submitted by the learned counsel for the petitioner that vide order dated 24.11.2021 passed in ABA No. 8670 of 2021, the petitioner was directed to surrender before the court below within six weeks and to deposit Rs. 20,000/- as ad interim victim compensation by way of demand draft drawn in favour of the informant. It is further submitted that though the petitioner had prepared the aforesaid demand draft, the copy of which is kept at page 9 (Annexure 2) of the brief but due to unavoidable circumstance, he could not he could not surrender within the stipulated time but now the petitioner is ready to surrender in the court below. Learned counsel for the petitioner undertakes to revalidate the demand draft, as the said demand draft dt. 05.01.2022 is going to be invalid due to efflux of time shortly. Learned counsel for the petitioner submits that the time to surrender before the court below in terms of the order 24.11.2021 passed in ABA No. 8670 of 2021 be extended for six weeks from the date of this order.
Considering the facts of the case and the submission of the learned counsel for the petitioner, the prayer for extension of time for the petitioner to surrender in the court below in terms of the order dated 24.11.2021 passed in ABA No. 8670 of 2021 is allowed.
Hence, the petitioner is directed to surrender before the court below “within six weeks from the date of this order in terms of the order dated 24.11.2021 passed in ABA No. 8670 of 2021”.
The order dated 24.11.2021 passed in ABA No. 8670 of 2021 is modified to the aforesaid extent only.
This criminal miscellaneous petition is disposed of
accordingly.
