This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of A.B.A. No. 9822 of 2021 to its original file.
Learned counsel for the petitioner submits that the A.B.A. No. 9822 of 2021 was rejected as not pressed vide order dated 04.01.2022. Learned counsel for the petitioner submits that due to network issue, he could not appear in the Court to press the matter, when the case was called out. It is further submitted that the petitioner has very good grounds to agitate in this case and unless the same is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that A.B.A. No. 9822 of 2021 be restored to its original file.
Learned Addl. P.P. has no serious objection for the prayer of restoration of anticipatory bail application.
Considering the aforesaid submission of the learned counsel for the petitioner, A.B.A. No. 9822 of 2021 is restored to its original file to the stage, it was before its dismissal.
List A.B.A. No. 9822of 2021 after a week.
