The present petition has been filed for quashing of order dated 04.09.2018 passed in Complaint Case No. 154 of 2016, whereby bail bond of the petitioners have been cancelled and N.B.W. has been issued, pending in the court of learned Judicial Magistrate, Ist Class, Giridih.
Learned counsel for the petitioners submits that learned court has cancelled the bail without issuing any notice to the bailors. He submits that petitioners are ready to appear before the learned court.
In view of the above facts and considering the submission of petitioners, in the interest of justice it will be suffice if the petitioners be directed to appear before the learned court on the date fixed by this court.
Accordingly, the petitioners are directed to appear before the learned court on or before 14.11.2022. If the petitioners appear on or before such date, N.B.W. shall not be given effect to and the petitioners shall be allowed to remain on same bail bond which has been cancelled.
It is made clear that if the petitioners fail to appear before the learned court on or before the date assigned by this Court, the learned court shall take all the coercive steps against the petitioners.
With the aforesaid observation and direction, this criminal miscellaneous petition stands disposed of. I.A., if any, stands disposed of.
