05/15-2-2022 So far as defect no. 9 (vi) is concerned, learned counsel for the petitioner undertakes to remove the same within a period of two weeks. So far as rest defects are concerned, the same are ignored.
Heard the parties.
This application has been preferred by the petitioner for cancellation of the anticipatory bail granted to the opposite party no. 2 in A.B.A. No. 3363 of 2020 vide order dated 9th September, 2020.
Learned counsel for the petitioner while referring to Section 438 (2) of Cr.P.C. has stated that regular threats are being meted out to the petitioner by the O.P. No. 2, for which a complaint was also made to Gobindpur Police Station, but no action has been taken upon him.
It appears that the O.P. No. 2 was granted anticipatory bail in A.B.A. No.3363 of 2020 vide order dated 9.9.2020 on the reasons enumerated in the said order. So far as the threatening, which is being given by the O.P. No. 2 to the petitioner is concerned, as stated by the learned counsel for the petitioner, the same seems to be without any basis as no written complaints were ever made to the police station.
The reasons assigned by the learned counsel for the petitioner do not implore this Court to cancel the anticipatory bail application granted to the O.P. No. 2 in A.B.A. No.3363 of 2020.
Accordingly, this application sans merit stands dismissed.
