Petitioner is apprehending his arrest in connection with Ghaghra P.S. Case No. 64 of 2022 for the offences registered under Sections 379, 413, 414/34 of the Indian Penal Code, under Rule 54 of Jharkhand Miner Minerals Concession Rules, 2004 and under Rule 13 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017, pending in the court of learned Sub-Divisional Judicial Magistrate, Gumla.

It is alleged that on 25.05.2022 at about 12:15 noon, the informant on the basis of confidential information seized huge quantities of sand accumulated at several places in Village - Duko Patratoli.

It appears that on the basis of local inquiry it came to knowledge that petitioner had accumulated the seized sand at one of the place.

It was submitted that petitioner has been made accused only on the basis of suspicion and names of witnesses, who has given the name of the petitioner has not been disclosed.

Learned A.P.P. has opposed the prayer for bail, but does not dispute the aforesaid facts.

Regard being had to the facts and circumstance of the case, petitioner is directed to surrender before the court below within two weeks from the date of receipt of copy of this order, and learned court below on his surrender shall release him on bail on furnishing bail bond of Rs. 25,000/- (Twenty five Thousand only) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Gumla in connection with Ghaghra P.S. Case No. 64 of 2022. Subject to the conditions as laid down under Section 438 (2) Cr.P.C.
