The petitioner is apprehending his arrest in connection with Nimiaghat P.S. Case No. 104 of 2020, for the offences under Sections 379, 414, 467, 468, 471, 420, 120(B) of the Indian Penal Code and Section 30 (ii) of the Coal Mines Act, pending in the court of Ms. Saquia Kaushar, learned Judicial Magistrate, Giridih.

It is alleged that 10.09.2020 at about 2:45 P.M, Nimiaghat police intercepted a truck bearing Registration No. JH10AC-2555 and seized about 25 tons of coal.

It is further alleged that the documents for transportation of coal revealed that the same was to be delivered to M/s Siya Ram Hard Coke, Giridih but it subsequently transpired that the driver was transporting the same to M/s Shree Industries Kharni, Dhanbad.

It appears that co-accused namely Amit Kumar Singh being the proprietor of M/s. Shree Industries, Karni, Dhanbad, has been granted anticipatory bail by this Court in A.B.A No.6190 of 2022.

It was submitted that no case under Sections 379, 414, 467, 468, 471, 420 and 120B of the Indian Penal Code and Section 30 (ii) of the Coal Mines Act will be made out against the petitioner as he was a bonafide purchaser.

Learned counsel for the State has opposed the prayer for bail but does not dispute the aforesaid fact.

Regard being had to the facts of the case; I am inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, the petitioner, named above, is directed to surrender in the court below within two weeks from the date of receipt / production of a copy of this order, and in the event of his surrender in the court below, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of Ms. Saquia Kaushar, learned Judicial Magistrate, Giridih, or her successor, in connection with Nimiaghat P.S. Case No. 104 of 2020, on the conditions as laid down under Section 438 (2) Cr.P.C.
