Petitioner is apprehending his arrest in connection with Palkot P.S. Case No. 10 of 2022 for the offences registered under Sections 379, 504, 506 read with Section 34 of the Indian Penal Code, pending in the court of learned A.C.J.M., Gumla.

It is alleged that petitioner and co-accused persons had cut down the Kusum trees of informant.

It was submitted that the occurrence is alleged to have taken place on 26.10.2021, but the complain case was filed on 14.02.2022, which was sent to Palkot police station for registration of F.I.R. under Section 156 (3) Cr. P.C. It was further submitted that there is general and omnibus allegation against the petitioner.

Learned A.P.P. has opposed the prayer for bail, but does not dispute the aforesaid facts that the complain case was filed after four months from the date of occurrence.

Regard being had to the facts and circumstance of the case, petitioner is directed to surrender before the court below within two weeks from the date of receipt of copy of this order, and learned court below on his surrender shall release him on bail on furnishing bail bond of Rs. 25,000/- (Twenty five Thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Gumla in connection with Palkot P.S. Case No. 10 of 2022. Subject to the conditions as laid down under Section 438 (2) Cr.P.C.
