Heard the Parties.

Petitioners are apprehending their arrest in connection with Narayanpur P.S. Case No. 92 of 2022 for the offences registered under Sections 147/ 148/ 149/ 341/ 323/ 325/ 307/ 379 of the Indian Penal Code, pending in the court of learned Additional Chief Judicial Magistrate, Jamtara.

It appears that on 30.07.2022 at about 6:00 am., the petitioners alongwith other co-accused persons stopped the informant from declogging his drain, when the informant protested, petitioner No.2 namely Prem Chandra Mandal @ Prem Chandra Mondal and Petitioner No.3 namely Krishna Kumar Mandal @ Krishna Mondal assaulted the informant parties causing injuries.

It appears that Nimai Mondal, brother-in-law of the informant sustained grievous injuries.

It was submitted that there is a case and counter case between the parties and both the sides have sustained injuries. It was further submitted that as far as petitioner No.1 namely Shridhar Mondal, petitioner No.4 namely Urmila Devi and petitioner No.5 namely Basanti Devi are concerned, there is general allegation against them.

Learned A.P.P. assisted by Mr. Raj Nandan Chatterjee learned lawyer appearing for the informant have opposed the

prayer for bail, but does not dispute the aforesaid facts.

Considering the facts and circumstance of the case, I am not inclined to release the Petitioner No.2 namely Prem Chandra Mandal @ Prem Chandra Mondal and Petitioner No.3 namely Krishna Kumar Mandal @ Krishna Mondal on bail, accordingly, their prayer for anticipatory bail application stands rejected.

As far as petitioner No.1 namely Shridhar Mondal, petitioner No.4 namely Urmila Devi and petitioner No.5 namely Basanti Devi are concerned, they are directed to surrender before the court below within two weeks from the date of receipt of copy of this order, and learned court below on their surrender shall release them on bail on furnishing bail bond of Rs. 25,000/- (Twenty five Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jamtara in connection with Narayanpur P.S. Case No. 92 of 2022. Subject to the conditions as laid down under Section 438 (2) Cr.P.C.
