Petitioner is apprehending his arrest in connection with Hussainabad P.S. Case No. 76 of 2022, for the offences registered under Sections 341, 323, 325, 307, 504, 506/34 of the Indian Penal Code, pending in the court of learned S.D.J.M., Palamau.

It is alleged that on 18.03.2022, co-accused Nand Lal Ram started tearing clothes of the people, who had assembled in the village to celebrate the Holi Festival. When the informant party opposed the act, accused persons assaulted him and his family members. Sunita Devi sustained grievous injury.

It was submitted that there is a case and counter case between the parties for the same occurrence. It was further submitted that the petitioner had instituted Hussainabad P.S. Case No.79/2022 against the informant and other accused persons under Sections 341, 323, 307, 504, 506/34 of the IPC. It was further submitted that from the perusal of the written report of the petitioner in the aforesaid case, it is evident that the informant and other accused persons have assaulted them causing injuries.

There is general allegation against the accused persons of having assaulted the informant parties. There is a case and counter case between the parties and both the sides sustained injuries.

Learned A.P.P. has opposed the prayer for bail, but does not dispute the aforesaid facts.

Regard being had to the facts and circumstance of the case, petitioner is directed to surrender before the court below within two weeks from the date of receipt of copy of this order, and learned court below on his surrender shall release him on bail on furnishing bail bond of Rs. 25,000/(Twenty five Thousand only) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Palamau in connection with Hussainabad P.S. Case No. 76 of 2022. Subject to the conditions as laid down under Section 438 (2) Cr.P.C.
