Arti Kumbhkar Alias Arti Kumbhakar Vs the State of Jharkhand

The learned counsel for the petitioner submits that the alleged seized material is less than small quantity. It is further submitted that that the petitioner is a lady and she has no criminal antecedent. It is further submitted that the petitioner was sitting in the car and did not run away and even tried to do so, moreover she is in custody from 16.06.2022 and therefore, the bail should be allowed to the petitioner.

Learned counsel for the State, on the other hand, has opposed the bail application and pointed out that it is a drug related offence which is serious in nature.

Having heard both counsels, gone through the records of the case, considering the period of custody and in the facts and circumstances of the case, I am inclined to release the petitioner, named above, on bail, on furnishing bail bond of Rs. 20,000/- (rupees twenty thousand only) with two sureties of the like amount each to the satisfaction of learned Principal District Judge at Jamshedpur in connection with Mango P.S. Case No. 194 of 2022, subject to the condition that petitioner shall remain present on each and every date of trial before the Court below unless dispensed with by the learned Court below.
