The learned counsel for the petitioner has submitted that the petitioner is innocent and has committed no offence whatsoever alleged in the FIR. It is apparent from the fardbeyan of the informant that there is land dispute between the parties due to which the present false case has been lodged against the petitioner. The petitioner was not arrested from the place of occurrence rather he was arrested from his house. No incriminating article has been recovered from the possession of the petitioner. Moreover, the petitioner is in custody since 06.04.2021. Therefore, petitioner may be released on bail.

Learned APP, appearing on behalf of the State, has vehemently opposed the bail application of the petitioner and has submitted that the witnesses vide their statement mentioned at paragraph Nos. 6, 8, 9, 10 & 11 of the case diary have supported the prosecution version and also with regard to the spade blow given by this petitioner on the head of the deceased.

Having gone through the records of the case and the arguments advanced by the learned counsel for both the sides, present petitioner, named above, is ordered to be released on bail on executing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VI, Palamau at Daltonganj, in connection with Lesliganj PS Case No. 106 of 2020, corresponding to GR No.1395 of 2021 (ST Case No.197 of 2021), subject to the conditions that (i) the

petitioner shall report to the concerned police station on last Saturday of every month between 1:00 PM and 5:00 PM in the next twelve months, failing which his bail bonds shall be cancelled. Any exemption to such attendance shall be done so after direction from the learned Court below and (ii) the petitioner shall also remain present on each and every date of trial before the learned Court below unless dispensed with by the learned Court below.
