Bail application of this petitioner was earlier rejected by this Court in B.A. No.9809 of 2021 vide order dated 01.11.2021.

The petitioner has been made an accused in connection with Kamdara P.S. Case No. 13 of 2021, corresponding to G.R. No. 389 of 2021, for the offences under Sections 147, 148, 149, 302, 460, 458, 380, 120-B of the Indian Penal Code and Sections 3 / 4 of the Witchcraft Practices Act, pending in the court of Sri Pranav Kumar, learned Judicial Magistrate, Gumla.

It is alleged that on 24.02.2021, five members of a family were murdered by unknown persons on the ground that they practiced witchcraft.

As far as the petitioner is concerned, it is alleged that he had only participated in the village meeting and chastised the deceased persons for practicing witchcraft.

It was submitted that petitioner was arrested along-with co-accused persons and on the basis of the confessions of co-accused persons, incriminating articles were recovered. No recovery was made on the basis of his confession. It was further submitted that similarly situated co-accused persons have been granted bail by the coordinate bench of this Court and the case of this petitioner stands on a similar footing.

Regard being had to the facts of the case, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Sri Pranav Kumar, learned Judicial Magistrate, Gumla, or his successor, in connection with Kamdara P.S. Case No. 13 of 2021, corresponding to G.R. No. 389 of 2021.
