The petitioner is apprehending his arrest in connection with Dumri P.S. Case No. 59 of 2022, for the offences under Sections 467, 468, 471, 120-B, 420 and 414 of the Indian Penal Code, Rule 9(1) of the Jharkhand Mineral Rules and Section 30 (2) of the Coal Mines Act, pending in the court of Shri Edith Horo, learned Judicial Magistrate, 1^st class, Giridih.

It appears that on 21.04.2022, Dumri police seized several trucks, on which, illegal coal were loaded.

Petitioner happens to be the owner of one of the seized trucks bearing Registration No. JH-02S-7942.

It was submitted that the driver of the said truck without knowledge and consent of the petitioner had loaded the seized coal. It was further submitted that similarly situated co-accused persons have been granted anticipatory bail by coordinate benches of this Court.

Regard being had to the facts of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, the petitioner, named above, is directed to surrender in the court below within two weeks from the date of receipt / production of a copy of this order, and in the event of his arrest or surrender in the court below, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of Shri Edith Horo, learned Judicial Magistrate, 1^st class, Giridih, or his successor, in connection with Dumri P.S. Case No. 59 of 2022, on the conditions as laid down under Section 438 (2) of the Cr.P.C.
