1. Heard learned counsel for the applicant and learned A.P.P.

2. The applicant, who is in custody since 10.03.2022, has approached this Court for grant of regular bail in connection with N.D.P.S. Case No.26 of 2022, arising out of Murhu P.S. Case No.39 of 2022, registered for the offence under Sections 18/ 25 of the N.D.P.S. Act.

3. It appears that the applicant has been made an accused of committing crime under the N.D.P.S Act.

4. Learned counsel for the applicant claims innocence of the applicant and it has been submitted that he is a self employed person. Even if the prosecution story is taken to be true than also he has been apprehended with 700 grams of opium which is intermediary quantity. It has further been submitted that no criminal antecedent has been reported against this applicant and he undertakes to participate in the trial.

5. On the other hand learned A.P.P has opposed the prayer for bail.

6. Considering the fact that no criminal antecedent has been reported against this applicant and the investigation is complete, I am inclined to enlarge the applicant on bail. Accordingly, the applicant is directed to be released on bail, on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, N.D.P.S., Khunti, in connection with N.D.P.S. Case No.26 of 2022, arising out of Murhu P.S. Case No.39 of 2022, on the condition that the applicant will submit self-attested photocopy of his Aadhaar Card and also submit his mobile number before the learned court below which he will always keep active and will not change it during pendency of this case without prior permission of the court.
