2. The applicant who is in custody since 26.11.2021 has approached this Court for grant of regular bail in connection with Gumla P.S. Case No.324 of 2021, registered for the offence under Section 27(b)(ii) of the Drugs and Cosmetic Act and under Section 18(c)/21(c) of the N.D.P.S. Act.

3. It appears that the applicant is accused of committing crime under Drugs and Cosmetic Act and N.D.P.S. Act and recovery of commercial quantity has been shown in the form of cough syrup.

4. Innocence has been claimed by the learned counsel for the applicant and undertaking has been given for participation in the trial. Further, it has been submitted that nothing has been recovered from the possession of this applicant. As per the prosecution story, he has not been arrested from the house rather from the road. The house does not belong to the applicant. On the above basis, the prayer for bail has been made.

5. On the other hand, counsel for the State has opposed the prayer for bail and it has been submitted that commercial quantity has been recovered from the possession of the applicant and ingredients of Section 37 of the N.D.P.S. Act is applicable.

6. Considering the nature of offence and the mandate of Section 37 of the N.D.P.S. Act., I am not inclined to enlarge the applicant on bail. Hence, the present bail application is, hereby, rejected.
