1. Heard learned counsel for the applicant and learned A.P.P.
2. The applicant, who is in custody since 14.09.2019, has approached this Court for grant of regular bail in connection with S.T. No.209 of 2020, arising out of Bero P.S. Case No.96 of 2019, registered for the offence under Section 302 of the Indian Penal Code.
3. It has been alleged that this applicant has beaten up his wife by lathi which has resulted in her death.
4. It has been submitted by the learned counsel for the applicant that the investigation is complete and the applicant undertakes to participate in the trial. It has further been submitted that considering the pre-conviction period of custody of the applicant, he may be enlarged on bail.
5. On the other hand learned A.P.P has opposed the prayer for bail.
6. Considering the period of custody and the fact that there is only circumstantial evidence against this applicant, I am inclined to enlarge the applicant on bail. Accordingly, the applicant is directed to be released on bail, on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.J.C – XXI, Ranchi, in connection with S.T. No.209 of 2020, arising out of Bero P.S. Case No.96 of 2019, on the condition that the applicant will submit self-attested photocopy of his Aadhaar Card and also submit his mobile number before the learned court below which he will always keep active and will not change it during pendency of this case without prior permission of the court.
