Heard learned counsel appearing for the petitioner and the learned counsel for the State and have gone through the impugned order. The petitioner is an accused for allegedly committing offence punishable under Sections 395, 412 of the Indian Penal Code.

Prayer for bail of this petitioner was earlier rejected by this Court on merits. Now, the petitioner has renewed his prayer for bail on the ground of custody.

Counsel for the petitioner submits that the accused was produced in the police station before the witness and he was made to identify in the police station and on that basis he identified the petitioner in the court also. .

Considering the aforesaid submission and the fact that the petitioner is in custody since 28.08.2017, I am inclined to enlarge the petitioner on bail. Accordingly, petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-V, Palamau at Daltonganj in connection with S.T. No. 374 of 2018, arising out of Chhattarpur P.S. Case No. 84 of 2017 (G.R .No. 1201/2017), subject to the condition that the petitioner will personally appear once in every month before the Trial Court and will mark his attendance till completion of the trial, failing which, Trial Court will take all steps for his re-arrest.
