The petitioner is apprehending his arrest in connection with Complaint Case No. 310 of 2020, for the offences under Sections 147, 149, 341, 323, 498A, 379, 504/34 of the Indian Penal Code and Sections 3 / 4 of D.P Act, pending in the court of M. P. Lakra, learned Judicial Magistrate, 1^st class, Giridih.

Petitioner happens to be the maternal uncle in law of the complainant. Complainant was married to Birendra Rawani. It is alleged that after marriage, Rs. three lakhs were demanded as dowry and to enforce the demand, the complainant was tortured and ultimately she was driven away from her matrimonial home.

It was submitted that husband of the complainant had given notice to the complainant under Section 9 of the Hindu Marriage Act for resumption of their conjugal relationship and after receipt of notice, this case has been filed. It was further submitted that husband of the complainant has also filed original suit bearing No.28 of 2020 under Section 9 of the Hindu Marriage Act.

Regard being had to the facts of the case; I am inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, the petitioner, named above, is directed to surrender in the court below within two weeks from the date of receipt / production of a copy of this order, and in the event of his surrender in the court below, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of M. P. Lakra, learned Judicial Magistrate, 1^st class, Giridih, or his successor, in connection with Complaint Case No. 310 of 2020, on the conditions as laid down under Section 438 (2) of the Cr.P.C.
