04/22.07.2022 Heard learned senior counsel for the applicant and learned A.P.P. for the State as well as learned counsel for the informant.

This anticipatory bail application has been filed on behalf of the abovenamed applicant seeking anticipatory bail in connection with Dhanbad P.S. Case No.181 of 2021 registered under Sections 323, 324, 307, 498-A, 120-B of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act pending in the court of learned Chief Judicial Magistrate, Dhanbad.

Learned senior counsel for the applicant has submitted that this F.I.R. was lodged against five named accused including the applicant with the allegation that the informant—victim was married with Shubham Goel and the middleman of the same was Sundar Goel. After solemnization of marriage, the husband and the family members had subjected her to cruelty for demand of dowry. It is also alleged that the applicant was also having active role in the alleged offence. Accordingly, this F.I.R. was lodged.

Learned senior counsel for the applicant has submitted that as per the allegations made by the informant in F.I.R., the applicant was the middleman and he is not in near relation of the husband of the victim. So far as the alleged demand of dowry is concerned, the applicant is not beneficiary of the same and he has been implicated in this case in order to humiliate him on being arrested by the police. The applicant is having no criminal antecedent and is not likely to flee away from justice, if enlarged, on anticipatory bail.

Learned A.P.P. appearing on behalf of the State as well as learned counsel for the informant vehemently opposed the contentions made by the learned senior counsel for the applicant.

In view of the above, no useful purpose would be served in keeping the present application pending or calling for counter affidavit from the State. Without expressing any opinion on the merits of the case, the applicant is entitled to be released on anticipatory bail, at this stage.

In the event of arrest, the abovenamed applicant, involved in the aforesaid case be released on anticipatory bail on his furnishing bail bond of

Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount

to the satisfaction of the court concerned on the following conditions:-

i. The applicant shall make himself available for interrogation by a police officer as and when required.

ii. The applicant shall not, directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer or tamper with the evidence.

iii. In default of any of the conditions mentioned above, the investigating officers shall be at liberty to file appropriate application for cancellation of anticipatory bail granted to the applicant.

iv. The applicant shall co-operate in the trial before the court below and in case of non-cooperation, the trial court would be at liberty to cancel the bail of the applicant without any reference to this Court.
