06/ 21.07.2022 Heard learned counsel for the applicant and learned A.P.P. for the State.

This bail application has been filed on behalf of the applicant–Subhash Kumar Yadav @ Subhash Prasad Yadav with prayer to release on bail in connection with Sahibganj (M) P.S. Case No. 236 of 2019, registered under Sections 147, 148, 149, 323, 307, 504, 506, 302 of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, Sahibganj.

Learned Counsel for the applicant has submitted that the F.I.R. of this case was lodged against eight named accused including the applicant with these allegations that brother of the informant Kanchan Mandal and Rohit Mandal were assaulted by Munna Yadav, Uma Yadav and Kundan Yadav with spear, Gadasa and Lathi whereby his brother Kanchan Mandal was grievously injured. In the meantime, Lalu Yadav, Pankaj Yadav, Subodh Yadav, Sikendra Yadav and Dablu Yadav also came there armed with deadly weapon and assaulted to Rohit Mandal. He took to his brother Kanchan Mandal to the Hospital where he died.

Learned Counsel for the applicant has submitted that, as per F.I.R. allegations, three accused Munna Yadav, Uma Yadav and Kundan Yadav had assaulted to the brother of the informant Kanchan Yadav whereby he was grievously injured. In the meantime, remaining accused attracted there and assaulted to his another brother Rohit Yadav. Role assigned to all the named accused is general and omnibus. Accused Munna Yadav has been granted bail in bail in B.A.No. 7752 of 2020 vide order dated 12.10.2020; Uma Yadav @ Subodh Kumar Yadav & Kundan Yadav @ Kundan Kumar Yadav have been granted bail in B.A.No. 3758 of 2020 vide order dated 06.07.2020; Lalu Yadav has been granted bail in B.A.No. 8241 of 2020 vide order dated 19.10.2020 and Sikandar Yadav has been granted bail in B.A.No. 866 of 2020 vide order dated 04.02.2020 by the Co-ordinate Bench of this Court and the applicant has been languishing in Jail since 25.02.2022.

Learned A.P.P. appearing on behalf of the State vehemently opposed the contentions made by the learned counsel for the applicant.

In view of the submissions made and materials on record, the bail application of the applicant is hereby allowed. Let the applicant be released on bail on furnishing bail bond of Rs.30,000/-(Rupees Thirty Thousand) with two sureties of the like amount to the satisfaction of the court concerned in aforesaid case.
