Heard learned counsel for the parties.

Apprehending his arrest in connection with Bariyatu P.S. Case No. 268 of 2021 instituted under Sections 406, 420/34 of the Indian Penal Code, the petitioner has moved this Court for grant of privilege of anticipatory bail.

It is alleged that petitioner introduced the informant to one coaccused Ashok Gaur with proposal for developing a piece of land which belongs to co-accused Ashok Gaur. It is further alleged that the informant paid approximately Rs.27 lakhs to the co-accused on different dates as well as Rs.14 lakhs was spent in boring work and leveling work over of the said land. It is further alleged that petitioner realized Rs.1.5 lakhs as liaisoning money at the instance of the co-accused-Ashok Gaur.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has committed no offence at all as alleged in the FIR. Both the counsels submitted that the parties have settled their dispute through mediation at JHALSA, Ranchi and the copy of which has been annexed in the petition. Petitioner undertakes to co-operate with the investigation of the case. Hence, petitioner may be extended the privilege of anticipatory bail.

Learned Addl.P.P appearing for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the facts and circumstances of this case, the nature of allegation against petitioner coupled with materials available on record, I am inclined to extend privilege of anticipatory bail to the petitioner. Accordingly, the petitioner is directed to surrender before the Court concerned within four weeks from today on furnishing bail bond of Rs.20,000/- (Twenty thousand) with two sureties of the like

amount each to the satisfaction of learned JM, Ranchi in connection with Bariyatu P.S. Case No. 268 of 2021.

It is made clear that the terms and conditions of settlement arrived at between the parties through Mediation at JHALSA, Ranchi shall be treated as conditions of anticipatory bail and with further condition that petitioner shall co-operate with the investigation of the case and appear before the investigating officer as and when noticed by him and furnish her mobile number and photocopy of the Aadhar Card with an undertaking that she will not change her mobile number during the pendency of the case and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
