The matter was taken up through Video Conferencing. Learned counsel for the parties had no objection with it and submitted that the audio and video qualities are good.

The petitioner is an accused in connection with Giridih (T) P. S. Case No. 63 of 2018 corresponding to G. R. No. 696 of 2018 registered under Sections 341/323/452/325/307/504/506/34 of the Indian Penal Code.
Heard learned counsel for the petitioner and learned counsel for the State.
It is submitted that the petitioner is innocent. It is submitted that the petitioner was alleged to be present at the place of occurrence, but he had not made firing. It is submitted that another co-accused namely Vicky Ram @ Viccky Ram has already been granted bail by the Co-ordinate Bench of this Court in B. A. No. 2120 of 2019 vide order dated 05.04.2019. It is submitted that the petitioner has got no criminal antecedent. It is submitted that the petitioner is in custody since 10.08.2021 and hence he may be enlarged on bail.
On the other hand, learned A.P.P has opposed the prayer for bail.
From perusal of the FIR and the impugned order passed by the learned Court below, it appears the petitioner is alleged to
be present at the place of occurrence, but no overt act is attributed to him. It appears that another co-accused namely Vicky Ram @ Viccky Ram has already been granted bail by the Bench of this Court in B. A. No. 2120 of 2019 vide order dated 05.04.2019.
Considering the facts and in the circumstances of this case, the petitioner namely Shubham Ram @ Shubham Kumar is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Learned Chief Judicial Magistrate, Giridih or its successor Court in connection with Giridih (T) P. S. Case No. 63 of 2018 corresponding to G. R. No. 696 of 2018, subject to the condition that one of bailors must be own relative of the petitioner and the petitioner shall remain present on the date of framing of charge.
