02/04.02.2022 The petitioner is an accused in connection with Pratappur P. S. Case No. 170 of 2021 registered under Sections 498A/304(B)/34 of the Indian Penal Code.
Heard learned counsel for the petitioner and learned counsel for the State.
It is submitted that the petitioner is the Bhaisur of the deceased and has not demanded any dowry. It is submitted that the petitioner is living separately from the house of his brother and the deceased. It is submitted that the petitioner is in custody since 26.08.2021 and hence he may be enlarged on bail.
Learned A.P.P has opposed the prayer for bail and has submitted that the petitioner is the Bhaisur of the deceased and demanded dowry and he is alleged to have committed the death of the deceased and as such, his bail application is fit to be rejected.
Perused the FIR and the impugned order passed by the learned Court below.
It appears that the petitioner is the Bhaisur of the deceased.
Considering the facts and in the circumstances of this case, the petitioner namely Ravindra Kumar Gupta is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten
thousand only) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Chatra in connection with Pratappur P. S. Case No. 170 of 2021 subject to conditions that the petitioner shall co-operate during trial and the petitioner shall remain present before the Learned Court below as and when required.
