Learned counsel for the petitioner has submitted that the petitioner is innocent and has committed no offence at all as alleged in the complaint petition. It is further submitted that the Original Maintainace case No.297 of 2021 pending between parties, the terms and conditions entered into through mediation center, Tenughat dated 15.07.2022 that both parties got one time settlement as per terms and conditions at the time of furnishing bail bond in this case. It is further submitted that petitioner undertook before the Mediation Centre, Civil Court, Bermo at Tenughat to pay Rs.5,00,000/-(five lacs) to the opposite party no.2 in installment as alimony till the disposal of the case and both parties shall get mutual divorce. It is further submitted that now petitioner undertakes to deposited Rs.1,00,000/- in the name of his wife namely Annu Devi by way of demand draft without prejudice of his defence in this case. In case of his arrest at the hands of police, prestige and reputation of the petitioner shall be ruined. It is further submitted that petitioner undertakes to co-operate with the trial of the case and will not indulge in tampering with prosecution evidence and will abide by all terms and conditions imposed by this Court in the matter of granting anticipatory bail. Hence, it is submitted that the petitioner may be extended the privilege of anticipatory bail.
