07/ 02.08.2022 . Apprehending his arrest, petitioner above-named has moved this Court for grant of privilege of anticipatory bail in connection with Jamua P. S. Case No.55 of 2014 (G.R. No.488 of 2014) registered under Sections 409, 419, 420, 120B of the Indian Penal Code.

It is submitted by learned counsel for the petitioner that as per the prosecution case, the petitioner being the Principal of the Langta Baba College, Baba Gram, Mirganj, has received revenue of Rs.10,70,720/- in the Academic Year 2013-14 towards Admission, Registration, Migration etc. from the students, out of which, only a sum of Rs.98,000/- was deposited in the account of the said College and rest amount was misappropriated. It is further submitted that petitioner was restrained from the financial work vide orders passed in W.P.(S) No.2697 of 2007 and W.P.(S) No.1455 of 2009. It is further submitted by the learned counsel for the petitioner that the present case is outcome of dispute between the Management and Teachers. The amount received had been deposited as it will be evident from the Passbook of the said College enclosed with the FIR. The audit report of the college submitted by the chartered accountant for the financial year 2010-2013 shows that the accounts were in order. There is no prospect of absconding of the petitioner+

Learned APP for the State assisted by learned counsel for the Informant has vehemently opposed the prayer and has submitted that an Enquiry Committee was constituted to look into the matter which has been filed with the counter-affidavit at Page-16 of the counter-affidavit wherein it appears that the Committee was constituted vide Letter dated 10.09.2009 and the report was submitted indicting this petitioner to be involved in different type of mal-practices. It is submitted that from the page 32 of the case-diary it will be apparent that under executive magistrate inventory was prepared in which it was found that Rs 6,021,90.00 in the financial year 2011-2012 and Rs.34,62,640 2012-2013 was received from students as fees which were not deposited in the Bank. Despite the direction of this Court restraining the petitioner from exercising financial year, he continued to exercise financial power.

Considering the submissions of learned counsels and the fact as discussed above, the anticipatory bail application of the petitioner is rejected. The petitioner is directed to surrender within two weeks.
