The petitioner is an accused for the offence punishable under Section(s) 324, 326, 307, 506, 379, 341 and 34 of the Indian Penal Code.
Heard the learned counsel for the parties and I have gone through the entire record including the impugned order.
It is alleged that this petitioner and one Surendra Verma assaulted the informant and his wife by sword and axe.
Counsel for the petitioner submits that similarly situated co-accused, namely, Surendra Verma has been released on bail in BA No. 8615 of 2020 on 10.11.2020.
Learned A.P.P opposes the prayer for bail of the petitioner but has not controverted the aforesaid submission.
In view of the aforesaid fact, I am inclined to release the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Giridih in connection with Birni P.S. Case No. 146/2020.
