The petitioner is an accused for the offence punishable under Section(s) 302/34 of the Indian Penal Code.
Heard the learned counsel for the parties and I have gone through the entire record including the impugned order.
The informant, who is the brother of the deceased- Ravi Kumar, lodged the FIR against Ramesh Yadav suspecting that the deceased was killed by the Hywa owner-Ramesh Yadav, as he did not want to pay remuneration to the deceased, who used to drive the hywa.
From the FIR, it is apparent that there is no eye witness to the said occurrence, rather on suspension, the FIR has been lodged against Ramesh Yadav. Ramesh Yadav has confessed his guilt implicating the petitioner. Coaccused, Ramesh Yadav confessed that he was involved in commission of the offence assisted by this petitioner.
Counsel for the petitioner submits that co-accused Ramesh Yadav has been released on bail in B.A. No. 16270 of 2021 by a Co-ordinate Bench of this Court vide order dated 23.2.2022.
Considering the fact that co-accused Ramesh Yadav has been released on bail in B.A. No. 16270 of 2021 by a Co-ordinate Bench of this Court vide order dated 23.2.2022, I am inclined to release the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned District and Addl. Sessions Judge-I, Koderma in connection with Chandwara P.S. Case No. 82/2021 (S.T. No. 195/2021).
