2/09.03.2022 The lawyers have no objection with regard to the proceeding, which has been held through video conferencing today at 2.15 P.M. They have no complaint in respect to the audio and video clarity and quality.
Defects, pointed out by the office, are hereby ignored for the present.
Heard learned counsel appearing for the petitioners and the learned counsel for the State and have gone through the impugned order.
The petitioners are accused for allegedly committing offence punishable under Sections 395 & 397 Indian Penal Code.
It is alleged that some unknown miscreants entered the room of the informant and started assaulting him and others and, thereafter, looted cash and mobile etc. Further, as per the statement of the counsel for the petitioners, the petitioners were not put on T.I.P. and exactly similarly situated co-accused has been granted bail by this Court in B.A. No. 603 of 2022.
Learned A.P.P. opposes the prayer but cannot deny the fact that exactly similarly situated co-accused has been granted bail by this Court.
Considering the aforesaid fact and the fact that exactly similarly situated co-accused has been granted bail by this Court and the petitioners are not named in the FIR and charge sheet has already been submitted in this case, I am inclined to enlarge the petitioners on bail. Accordingly, both these petitioners, named above, are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Latehar in connection with Netarhat P.S. Case No. 24 of 2021 (G.R. No. 73/2022), subject to the condition that one of the bailers should be their close relative.
