02/04.05.2022 Since the present bail applications arise out of the same police station case number i.e., Deoghar (Town) P.S. Case No.502 of 2021, the same are being taken up together and disposed of by this common order.

These bail applications have been filed on behalf of the abovenamed applicants with prayers to release on bail in connection with Deoghar (Town) P.S. Case No.502 of 2021 registered under Section 392 of the Indian Penal Code pending in the court of learned Chief Judicial Magistrate, Deoghar.

Learned counsels for the applicants has submitted that the F.I.R. of this case was lodged by the informant in regard to loot of Rs.45,000/- against the four unknown persons.

Learned counsels for the applicants has submitted that the F.I.R. of this case was lodged against the unknown persons and the name of the applicants transpired during investigation in confessional statement. It is further submitted that nothing incriminating article or any looted money was recovered from the possession of the applicants. It is also submitted that no Test Identification Parade was conducted to identify the complicity of the applicants in commission of the alleged offence, while the informant – victim had specifically stated that he could identify the assailants, if brought before him. The applicants have been languishing in jail since 6^th December, 2021.

Learned A.P.P. appearing in both the cases on behalf of the State vehemently opposed the contentions made by the learned counsels for the applicants and contended that the applicants are having criminal antecedents.

In view of the submissions made and materials on record, the bail applications of the applicants are hereby allowed. Let the applicants be released on bail on furnishing bail bonds of Rs.25,000/-(Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of the court concerned in aforesaid case.
