3/02.05.2022 Heard learned counsel for the applicant and learned APP for the State.

The bail application has been filed on behalf of the abovenamed applicant with a prayer to release on bail in connection with Chainpur P.S. Case No.182 of 2021 under section 392 of the IPC and charge sheet has been submitted under Sections 395/412 of the IPC, pending in the court of SubDivisional Judicial Magistrate, Palamau at Daltonganj.

Learned counsel for the applicant has submitted that FIR of this case was lodged by the informant against 3 named miscreants in regard to loot of one bag containing therein Rs.1,57,000/-, Adhar Card, RC Paper, two ATM Cards, PAN Card, and one mobile phone.

Learned counsel for the applicant has submitted that FIR of this case was lodged against unknown persons. Nothing incriminating article was recovered from the possession of the applicant. TIP was conducted in which the applicant was not identified. The applicant has been languishing in jail since 01.10.2021.

Learned APP appearing on behalf of the State vehemently opposed the contentions made by the learned counsel for the applicant.

In view of the submissions made and the materials on record, these bail applications of the applicant is allowed. Let the applicant be released on bail on furnishing bail bond of Rs.20,000/- (Rupees twenty thousand) with two sureties of like amount to the satisfaction of the court concerned in the aforesaid case.
