Tahir Ansari Vs the State of Jharkhand

Counsel for the petitioner submits that the petitioner is neither named in the FIR nor he has been put on T.I.P. He submits that he is in custody since 05.10.2021 and exactly similarly situated co-accused Bablu Kumar Barnwal has already been granted bail by a Coordinate Bench of this Court in B.A. No. 15896 of 2021 on 07.02.2022. It is contended that no incriminating article was recovered from the possession of this petitioner.

It is alleged that on 22.09.2021, some unknown person entered into the Electric Sub-Station, Lalpania and took away copper coil of transformer and two conductors.

Considering the fact that nothing incriminating has been recovered from the possession of this petitioner not he has been put on T.I.P. and he is in custody since 05.10.201 as well as the fact that similarly situated co-accused has already been granted bail by a Coordinate Bench of this Court, I am inclined to enlarge the petitioner on bail. Accordingly, petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Bermo at Tenughat in connection with Mahuatand P.S. Case No. 43 of 2021 (G.R. No 1164 of 2021).
