Heard learned counsel for the parties.

The petitioner is an accused for the offences punishable under Sections 414/419/420/467/468/471/120-B of the Indian Penal Code and Sections 66(B), 66(C), 66(D) of the Information Technology Act.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the FIR. Except recovery of one mobile phone, 2 SIM cards, 2 ATM cards, 3 passbooks and one cheque book from the possession of the petitioner, the police has not been able to establish as to in what manner the petitioner was allegedly committing cyber crime. The petitioner is in judicial custody since 23.09.2021 and the chargesheet against him has already been submitted. Hence, the petitioner may be given the privilege of regular bail.

The learned A.P.P. while opposing the petitioner’s prayer for bail submits that during investigation of the case, the statements of several witnesses were recorded in which they have stated that the petitioner and other co-accused persons were involved in commission of cyber crime. The investigation of Customer Acquisition Form (CAF) also reveals that mobile SIM cards were issued in the name of other persons of different states in which several e-wallets were created.

There is one criminal case of similar nature pending against the petitioner.

Having heard learned counsel for the parties and keeping in view that the petitioner is in judicial custody since 23.09.2021 and the chargesheet against him has already been submitted, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I, Jamtara in connection with Cyber Crime P.S. Case No. 62/2021, subject to the condition that one of the bailers shall be his close relative.
