This bail application has been filed on behalf of the applicant– Milan Turi with prayer to release on bail in connection with Mandu (Kujju) P.S. Case No.75 2021 under Sections 302/34 of the Indian Penal Code and Sections 25(1-B)a/26/27/35 of the Arms Act pending in the court of learned A.C.J.M., Ramgarh.

Learned counsel for the applicant has submitted that the F.I.R. of this case was lodged by the informant in regard to murder of his brother, who was clerk at CCL kanta by the unknown persons in the night. Learned counsel for the petitioner has further submitted that the name of the applicant is not figured in F.I.R., rather his name surfaced in the confessional statement of coaccused Tabarak Ansari who incriminating himself also implicated the applicant and co-accused Om Prakash Saw in commission of the murder of brother of the informant. Similarly situated co-accused Om Prakash Saw has already been granted bail by this Court vide order dated 23.12.2021 passed in B.A. No.13023 of 2021. The applicant has been languishing in jail since 24.06.2021.

Learned A.P.P. appearing on behalf of the State opposed the contentions made by the learned counsel for the applicant and contended that as per paragraph 18 of the case diary, Karma Oraon has also supported the prosecution story but he could not identify the miscreants because all had covered their faces.

In view of the submission made and material on record, the bail application of the applicant is hereby allowed. Let the applicant be released on bail on furnishing bail bond of Rs.30,000/-(Rupees Thirty Thousand) with two sureties of the like amount to the satisfaction of the court of learned A.C.J.M., Ramgarh in aforesaid case.
