06/ 20.01.2022 This bail application is on behalf of applicant Abdul Manan with a prayer to release him on bail in case crime being Mahila P.S. Case No. 28 of 2020, (District- Chatra), registered for the offence under Sections 506, 509, 313, 498A/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
Learned counsel for the applicant at the very outset has submitted that the applicant is on provisional bail vide order dated 07.12.2021, passed by a co-ordinate Bench of this Court and it was submitted by the learned counsel for both the sides that the dispute between the parties has been resolved and, accordingly, both the parties were directed to appear before Secretary, DLSA, Chatra on 18.12.2021 or any convenient date with their mutual consent and the Secretary DLSA, Chatra, was directed to submit the report on or before 10.01.2022. The report of the Secretary, DLSA, Chatra dated 04.01.2022 is on record, in which it has been stated that both the parties have decided to live as husband and wife and, accordingly, both are residing as husband and wife at her in-laws’ house and the victim has stated that she has no grievance against her husband or his family members and was living happily.
Learned counsel for the informant and learned A.P.P. also conceded that the dispute between the two has been resolved and the victim and the applicant are residing as husband and wife.
In view of the submissions made by learned counsel for the applicant, learned A.P.P. and learned counsel for the informant,
the provisional bail order dated 07.12.2021, passed by the coordinate Bench of this Court, is hereby confirmed.
