Learned counsel for the applicant undertakes to remove the defects, as pointed out by the office within a period of one week.

This bail application has been filed on behalf of the applicant– Rakesh Kumar with prayer to release on bail in connection with Gumla P.S. Case No.446 of 2020 registered under Sections 20(b)(ii)(c)/29 of the N.D.P.S. Act pending in the court of learned Sessions Judge, Gumla.

Learned counsel for the applicant has submitted that the F.I.R. of this case was lodged with the allegations that the police party chased the maruti echo car bearing registration no. JH01DQ/6112 and the persons who were in the said car fled away leaving the car at the place of occurrence from which 10 k.g. of ganja kept in 10 bags were recovered. It is further submitted that the applicant was not apprehended at the spot. Nothing incriminating article was recovered from his possession. The applicant is alleged to be the driver of the said car and the alleged contraband weighing to 10 k.g. which was recovered from the car was below the commercial quantity. The applicant has been languishing in jail since 20.07.2021.

Learned Spl. P.P. appearing on behalf of the State vehemently opposed the contentions made by the learned counsel for the applicant and contended that the applicant was the driver of the car from which 10 k.g. of ganja was recovered and the applicant managed to escape from the place of occurrence on being apprehended by the police.

In view of the submissions made and materials on record, the bail application of the applicant is hereby allowed. Let the applicant be released on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of the court of learned Sessions Judge, Gumla in aforesaid case.
