03/12.01.2022 Heard learned counsel for the applicant and learned A.P.P. for the State as well as learned counsel for the informant.

This bail application has been filed on behalf of the applicant– Pappu Kumar @ Pappu Raj with prayer to release on bail in connection with Special POCSO Case No.39 of 2021 under Sections 376(2)(i), 376(2)(n) of the Indian Penal Code and Section 6 of the POCSO Act pending in the court of learned Exclusive Special Judge, POCSO Act, Palamau at Daltonganj.

Learned counsel for the applicant has submitted that in this case applicant has been granted provisional bail vide order dated 26^th October, 2021. Learned counsel for the applicant has submitted that the F.I.R. of this case was lodged by the father of the victim against the applicant in regard to enticing away his minor daughter and also committing rape upon her, whereby she also became pregnant. It is further submitted that the applicant has solemnized marriage with the victim and both are living together as husband and wife and out of wedlock of the two, the child has born. In compliance of the order dated 26^th October, 2021, a supplementary affidavit has also been filed with the present bail application annexing the marriage certificate.

Learned A.P.P. as well as learned counsel for the informant conceded that the applicant has solemnized marriage with the victim and both are living together as husband and wife.

In view of the submissions made and material on record, the provisional bail granted to the applicant vide order dated 26^th October, 2021 in connection with the aforesaid case is hereby confirmed. Accordingly, this bail application is disposed of.
