2. The instant writ application has been preferred by the petitioner praying for a direction upon the respondent authorities to consider the case of the petitioner for his employment under Para 9.3.2. of National Coal Wage Agreement (N.C.W.A.).

3. Mr. A.K. Sahani, learned counsel for the petitioner submits that in Para 10 of the application it has been specifically stated that the case of the petitioner has not been considered even after lapse of several years. He fairly submits that the respondent authorities are duty bound to take a decision as such they may be directed to pass an order in accordance with law. 4. Mr. Das, learned counsel for the respondent C.C.L. submits that a detailed counter affidavit has been filed; however, since no order of rejection has yet been passed and since the matter is very old; the petitioner may be directed to file a fresh representation along with a copy of this writ application before Respondent No.4 and the same shall be considered in accordance with law and applicable N.C.W.A.

5. In view of the limited submission of rival parties, the instant writ application is disposed of by directing the petitioner to file a fresh representation along with a copy of this writ application within a period of two months from the date of receipt of this order before Respondent No.4.

If any such representation will filed by the petitioner, Respondent No.4 shall pass an appropriate order in accordance with law, rules, regulations and the applicable N.C.W.A.

6. With the aforesaid observation and direction the instant writ application stands disposed of.
