The instant writ application has been preferred by the petitioners praying therein for a direction upon the respondent authorities to consider the objection raised by the petitioners with regard to fixation of their salary in proper scale of pay and also to pay the arrears thereof to the petitioners after such fixation.

3. Mr. A. K. Sahani, learned counsel for the petitioners submits that in spite of the objection made by the petitioners the respondents have not taken any decision in the matter. As such, the respondents may be

directed to dispose of the objection raised by the petitioners regarding fixation of their salary in a proper pay scale.

Ms. Shrestha Mehta, learned counsel for the respondent-State submits that since the matter is very old; as such, the petitioners may be directed to file a fresh representation/objection with regard to fixation of their salary in proper pay scale before the respondent No.4, so that the same can be dispose of.

In view of the limited submission of learned counsel for the parties, the instant writ application, is hereby, disposed of by giving liberty to the petitioners to file a fresh representation(s)/objection(s) with regard to their claim of fixation of salary in proper pay scale before respondent no.4 within a period of three months from today. If any such representation(s) is/are filed before the respondent no.4; the same shall be disposed of after considering the objection in accordance with law, rule regulation and government notification within a period of four months from the date of receipt of such representation(s). If any amount would be found payable after fixation; the same shall be paid to the petitioners within a further period of eight weeks.

6. With the aforesaid terms, the instant writ application stands disposed of.
