05/13.01.2021 The present writ petition is taken up today through Video conferencing.

Pursuant to the order dated 17^th December, 2020, a copy of notification dated 5^th November, 2020 issued by the State Government has been brought on record by Mr. Mohan Dubey, A.C. to learned A.G. On perusal of the said notification, it appears that Mr. K. Sriniwasan, InCharge Secretary, Department of Mines and Geology, Government of Jharkhand has also been given charge of Mines Commissioner.

In view of the said fact, Mr. Kalyan Roy, learned counsel for the petitioner seeks permission to withdraw the present writ petition with liberty to prefer a revision against the order dated 14^th March, 2020 passed by the respondent no.2 before the Mines Commissioner, Jharkhand.

Mr. Mohan Dubey, A.C. to learned A.G. has no objection to the same.

Permission is accorded.

The present writ petition is dismissed as withdrawn with aforesaid liberty.

It is, however, observed that if the petitioner prefers a revision before the Mines Commissioner, Jharkhand by 27^th January, 2021 in terms with the provisions of Jharkhand Minor Minerals Concession Rules, 2004, the Mines Commissioner shall make all possible endeavor to dispose of the said revision within a period of one month from the date filing of the same. The parties shall co-operate the Mines Commissioner, Jharkhand in timely disposal of the said revision.
